Review and confirmation of foreign judgments
As a rule, sentences handed down by foreign courts or similar entities, namely sentences relating to divorce, civil partnership, regulation of parental responsibilities, are only effective in the Portuguese legal system after being reviewed and confirmed by a Court of Appeal.
For the sentence to be confirmed, according to Portuguese law, it is necessary:
There must be no doubts about the authenticity of the document containing the sentence;
That has become final and unappealable;
That the foreign court has jurisdiction;
That lis pendens or res judicata cannot be invoked;
That the defendant has been summoned to the action.
When the sentences relate to matrimonial matters and parental responsibility and come from courts in European Union countries, confirmation and review of a foreign sentence is waived.
